Know the Limits
Possession Limits
New York law distinguishes between what you can possess at home and in public.
At Home
- Up to 3 ounces of cannabis flower
- Up to 24 grams of concentrated cannabis
- Up to 5 pounds of cannabis stored securely (for personal cultivation harvests)
- Adults 21+ may cultivate up to 6 plants (3 mature, 3 immature) per person, max 12 per household
In Public
- Up to 2 ounces of cannabis flower on your person
- Up to 24 grams of concentrated cannabis
- Cannabis must not be visible or accessible while in a vehicle
- Open containers in vehicles are treated similarly to open alcohol containers
Consumption Rules
Where You Can and Cannot Use Cannabis
New York generally allows cannabis use wherever tobacco smoking is permitted, but with important exceptions.
Permitted Locations
- Private residences (your own home or with landlord permission)
- Licensed cannabis consumption lounges (where available)
- Anywhere tobacco smoking is permitted (public sidewalks, parks -- with exceptions)
Prohibited Locations
- Indoors at any workplace
- Inside any motor vehicle (even as a passenger)
- On school grounds, near schools, or on college campuses
- On federal property (post offices, federal buildings, national parks)
- Public transit vehicles and stations
- Any location where the property owner has prohibited it
- Restaurants and bars (unless they hold a consumption license)
Licensing
OCM Licensing and Why It Matters
The Office of Cannabis Management (OCM) is the state agency that regulates all aspects of legal cannabis in New York. Every legal dispensary holds an OCM-issued license.
Why buy licensed?
Licensed dispensaries sell lab-tested products verified for potency, pesticides, heavy metals, and mold. Unlicensed shops have no such requirements -- what's on the label may not be what's in the package.
How to verify a license
Ask to see the OCM license number, which should be displayed in-store. You can verify it on the OCM's public license database. Purple Buds' license number is OCM-RETL-25-000449.
Medical vs. adult-use
New York maintains separate medical and adult-use programs. Medical patients with qualifying conditions can access higher potency products and additional product types through Registered Organizations (ROs). Adult-use consumers shop at retail dispensaries like Purple Buds.
Driving
DUI Laws
Driving under the influence of cannabis is illegal in New York, period. Unlike alcohol, there is no standardized legal limit for THC in your system -- impairment is assessed through field sobriety testing and Drug Recognition Expert (DRE) evaluations.
Penalties for cannabis DUI are the same as alcohol DUI: fines, license suspension, and potential jail time. If you consume cannabis, do not drive. Wait until effects have fully subsided, which can be 4-8 hours for edibles.
Travel
Interstate Travel Rules
Cannabis remains federally illegal (Schedule I). Transporting cannabis across state lines is a federal offense, even between two states where cannabis is legal. This applies to driving, flying, trains, and any other form of interstate transport.
At airports: TSA operates under federal jurisdiction. If cannabis is found during screening, TSA may refer the matter to local law enforcement. While NY law enforcement may not prosecute, the safest practice is to consume your purchases within New York State.
